1. Classification

  • COFEPRIS category: cosmetic product. Definition: Art. 269 LGS (substances for the superficial parts of the body intended to clean, perfume, change appearance, protect, or keep in good condition — non-therapeutic). *Source: LGS (LeyesBiblio).

2. Sanitary procedure

  • Does NOT require sanitary registration. It operates with a Notice of Operation (Aviso de Funcionamiento) + Sanitary Officer.
  • Manufacturing in accordance with the Reglamento de Control Sanitario de Productos y Servicios (Regulation on Sanitary Control of Products and Services).

3. Labeling — NOM-141-SSA1/SCFI-2012

Sanitary and commercial labeling of prepackaged cosmetics (mandatory, domestic and imported). Source: DOF 19/09/2012, code 5269348. Label requirements:
  • Product denomination/name.
  • Name or business name and address of the responsible party.
  • Country of origin.
  • Batch number.
  • Instructions for use (where applicable).
  • List of ingredients preceded by the word “ingredients”, in descending order of concentration; the INCI nomenclature is recognized.
  • Net content.
  • Precautionary statements according to ingredients or product type.
  • No seals/octagons (those are for foods, NOM-051; they do not apply to cosmetics).
Oversight: COFEPRIS + PROFECO.

4. Prohibited claims

A cosmetic may not be attributed therapeutic/medicinal actions nor claim to cure/prevent diseases (that would turn it into a medicine). *Basis: LGS + Reglamento en Materia de Publicidad (Advertising Regulation).

5. What the EUM system RESOLVES

  • Claims → the prohibitedClaims guardrail blocks medicinal statements.
  • Batch + traceability → Smart COA (QR/CVV) covers batch and verification.
  • Label (INCI, descending order, statements) → objective of the compliance engine in Label Studio (review/enforce the NOM-141 fields). Pending.
